Educational Negligence

Special Educational Needs

Whilst most schools are now trying to provide for children with special needs, problems can still arise. For example the school may fail to recognise that a child has special educational needs or the school may be late in recognising the fact that a child has such needs. There may be inappropriate provision for a child and the Local Education Authority may provide the wrong school for the child, for example a mainstream school when a special school would have been more appropriate. Some examples of special educational needs are dyslexia, ADHD, autism, asperger syndrome etc

Bullying

We can advise on the legal issues in cases where there is clear evidence of bullying, be it physical or verbal or both, and no action or insufficient action has been taken by the school or Local Education Authority to deal with the problem.

Judicial Review

We have experience in Judicial Review claims involving challenging decisions of schools, Local Education Authorities, Colleges and Universities.

Maxwell Hodge have been involved in some important landmark cases in the education law field and we can therefore offer specialist advice.
