Personal Injury - Not all Car Crashes and Trips in the Street
As the players of Tottenham Hotspur have shown accidents can and do happen almost anywhere. Whilst fault for their episode of food poisoning has yet to be established many commentators are already predicting a multi-million pound compensation claim.
Many people are aware that they can claim compensation for a road accident or an injury from a trip or fall. However, it is also possible to claim for injuries caused by -:
-
accidents at work
-
sport
-
criminal acts
-
accidents on holiday
-
defective products or services
-
illness at work.
This latter category includes illness caused by for example asbestos, stress, repetitive strain, prolonged loud noises or lifting.
The two main ingredients in any successful personal injury claim are that there must have been an injury and there must have been negligence. If these can be shown then you need to speak to your solicitor. They will advise you on whether you have a viable claim and will usually be able to offer an initial free interview and “no win no fee”. Home visits may also be made for those with mobility difficulties.
The amount of compensation you will receive is dependent upon a number of factors. Compensation is awarded for pain, suffering, and loss of the ability to do things after an accident that you could do before. A claim will also be made for any financial loss suffered because of the accident including present and future loss of earnings.
All accidents have a limitation period after which a claim for compensation cannot be made. Any potential claim should be discussed with your solicitor as soon as possible.
